Appendix
(A)
The
implementation modalities
Based
on the signed accord between the NDA and the GOS in Cairo on the
16th of January 2005,
absorbing article ''12'' concerning the formation of a joint committee
from both parties to implement the aforesaid accord,
the joint committee was convened Sunday the 12th of June to Thursday
the 16th of the same month 2005 and affirmed the following:
Firstly:
1.
Removal of the state of emergency after the adoption of the interim
constitution.
2. Participation of the NDA in the National Constitution Review
Commission.
3. The NDA presents its position & views about the draft interim
national constitution to the national constitution review commission
for their inclusion in the draft constitution prior to the completion
of the work of the commission.
4. Consultation among the two parties and other political forces
for the formation of the other commissions as stipulated in the
interim constitution.
5. Represent women in all the legislative and executive institutions
in conformity with their role in society and to reinforce their
contribution to development.
Secondly:
The
two parties have agreed that the committee mentioned in article
'12' of the Cairo agreement should continue as a supreme committee
to supervise & follow up the implementation of the Cairo agreement
through the formation of the following three specialized committees:
1.
The political committee.
2. The legal committee.
3. The committee for the removal of injustices and grievances.
1- The political committee:
Responsible for following up the implementation of the following
tasks:
a. Preparation of the national consensus program,
mobilizing all political forces behind it and behind the peace
accords and reinforcing national unity. (Articles: 1-9, 1-12,
6-2, 6-3).
b. Formation of the national committee to evaluate
the experience of the federal system of government in the Sudan.(Article:
5-3).
c. Follow up the verification of the national,
non partisan nature of the army, other regular forces, and the
security and intelligence organs; through the mechanisms that
will be formed by the interim government for this purpose. (Articles:
8-1, 8-2, 8-3).
d. Formulate a common vision for reorganizing
the conditions and regulations of the judiciary system to realize
the independence of the judiciary. (Article 4-5).
e. Follow up what has been agreed upon concerning
the economic issues (Article 11).
2-
The legal Committee:
Will undertake the following tasks:
a.
Review the prevailing laws to amend or repeal any of
their terms that contravene the rights of association, expression,
the media, and all the basic rights; & to guarantee their
conformity with all the peace accords and the ratified international
covenants. (Articles: 2-2,7-2).
b. Initiate new draft laws that enhance better
judicial management, democratic transformation, and guarantee
the freedom of association, of expression, of trade union activities,
and of all types of political activities.
c. The committee will consult with all other
political forces.
d. The draft laws agreed upon will be referred
to the specialized bodies to be enacted.
3-
The committee for the removal of injustices and grievances:
a.
Constituting the national committee for the removal of
injustices and grievances according to a constituting order that
will enable the committee to perform its tasks in an effective
manner, and that its decisions become binding.
b.
The committee for the removal of injustices and grievances
will be entrusted to look into:
b.1 The cases of all those purged in all the state
apparatus for political reasons; the infamous ''national good'',
and take a decision in every case either by reinstating the person
back to service or by reasonable settlement for his or her situation
when his or her dismissal is confirmed for political reasons.
(Article: 9-2).
b.2
Remove the injustices and grievances resulting from any
violation of human rights or any negative material or moral practices.
(Article: 9-1).
c.
Follow up the settlement of the conditions of all the factions
and individuals of the NDA whose properties are afflicted by any
decisions or administrative measures; and work for remedying this
situation by their return to their owners or by compensation.
Thirdly:
The
committees will start their work immediately upon the signing
of this accord and that the supreme supervisory committee will
work out a time schedule for the work of these committees.
Fourthly:
The
participation of the NDA in the interim government's federal and
state organs:
Based on the agreement signed between the GOS and the NDA in Cairo
on the 18th of June 2005 and the signed peace accord between the
GOS and the SPLM/A in Nairobi on the 9th of January 2005 and the
interim constitution based on that and,
emanating from the need of exploring the aspects of reinforcing
the participation in government and its broadening that make it
effective and,
ensure the national objectives, achieve stability, security and
meet the wishes of the citizens; and,
believing that the participation in ruling and the administration
of the country should be based on a program established on the
consolidation of peace, reinforcing the democratic transformation,
preserving the unity of the country and addressing the livelihood
issues of the citizens; and,
taking note of the government's delegation exposition of the necessities
that required the participation frame stipulated in the peace
accord;
Firstly:
The two parties have agreed to pursue together the participation
of all the Sudanese political forces in the organs of the interim
government.
Secondly:
The two parties have agreed on the necessity that the broad based
government of national unity should be articulated on an agreed
upon interim program during the first three years of the interim
period.
Thirdly:
The two parties have agreed that the supreme committee entrusted
with the follow up of the execution of the accord, should pioneer
the reinforcement of participation both quantitatively and qualitatively.
Fourthly:
The
two parties have agreed that the NDA to participate in the organs
of the interim government in all of its following different
levels:
a. The national constitution review commission.
b. The cabinet of ministers of the broad based national unity
government.
c. The federal legislative assembly.
d. The governments and assemblies of the states.
e. The commissioners.
f. The national commissions.
