GUIDE TO THE LEGAL FRAMEWORK FOR THE SOUTHERN SUDAN STATE CONSTITUTIONS

OVER VIEW


PURPOSE:

The purpose of this guide is to support and assist the Southern Sudan State Constitutional Drafting Committees in preparing state constitutions that are compatible with the Interim Constitution of Southern Sudan (ICSS), the Interim National Constitution (INC) and the Comprehensive Peace Agreement (CPA), by:

providing a brief overview of the framework of those documents; and
highlighting the provisions of those documents that are most relevant to the roles and powers of the Southern States.

It should be noted that this guide has been specifically designed to be used as a reference tool by the Southern Sudan State Constitutional Drafting Committees in the process of drafting the state constitutions. It is not intended to be a general guide to the CPA, the INC or the ICSS, as it focuses most on the provisions that are relevant to the Southern States.

Further, the State Committees should not rely on this guide for the precise content of the CPA, the INC or the ICSS. This guide includes summary information only. For precise details regarding the content of the CPA, the INC or the ICSS, the Committees should refer directly to those documents.
